According to the plaintiffs, the country failed to comply with the order to present a qualified witness to testify about the national assets. The Petersen and Eton Park funds claim that Argentina presented a witness 'deliberately unprepared,' which they consider a maneuver to obstruct the discovery process. The plaintiffs seek to identify attachable assets to enforce the judgment issued by the Southern District of New York court. The information comes from a letter sent on January 21, 2026, by the law firm Levine Lee LLP to Judge Loretta A. Preska. In the document, which was accessed by Noticias Argentinas news agency, the legal representatives of the ruling's beneficiaries detail the alleged violations by the Argentine Republic regarding the August 2025 court orders. In the body of the note submitted to the court, the lawyers stated that 'the Republic's failure to produce a qualified witness is part of its strategy to evade the enforcement of the $16.1 billion judgment, including the concealment of over $1 billion in gold reserves'.
